Terms of service
Effective date: October 24, 2026
These terms are an agreement between you and CreativeCodeCA Web Inc. (“Creative Code”, “we”, “us” or “our”), the company that makes AgencyPhone. They apply when you visit agencyphone.com, create an account, or use AgencyPhone on the web, in the mobile app or through the API.
If you use AgencyPhone for an agency or a business, you accept these terms on its behalf and confirm that you are allowed to. If you do not agree to these terms, do not use AgencyPhone.
1.The service
AgencyPhone gives agencies business phone numbers for the businesses they serve (“clients”). A client's team calls and texts from those numbers in the AgencyPhone apps, and agencies can connect their own software through the API and webhooks. AgencyPhone works with numbers in the United States and Canada only, and international calls and texts are not supported.
2.Accounts
- AgencyPhone is for businesses. Give accurate information and keep it up to date.
- Keep your sign-in methods secure. You are responsible for everything that happens in your account, including your team, your subaccounts and the software you connect.
- Agencies decide who on their team and their clients' teams can use AgencyPhone, and remove people who should no longer have access.
- Tell us right away at info@creativecodeca.com if you think someone used your account without permission.
3.Fees, balance and payment
- Agencies pay as they go from a prepaid balance they add funds to by card. Monthly fees for subaccounts and numbers, and usage such as calls and texts, are taken from that balance. Current fees and usage rates are on the pricing page.
- Monthly fees are taken from your balance in advance, when you add a subaccount or number and each month after. Usage is taken from your balance as it happens. Carrier and texting registration fees are passed through as described on the pricing page. Taxes are added where they apply.
- When your balance runs low, outbound calls and texts may pause until you add funds. Incoming calls and texts keep working.
- If a payment fails, we may limit outbound use until it is resolved.
- We will tell you by email before a price change takes effect.
- Monthly fees are not refunded for part of a month. If you close your agency, contact us about any unused balance.
4.Acceptable use
You and your clients must use AgencyPhone lawfully. Do not use it to:
- Call or text people without the consent the law requires, including under the TCPA in the United States and CASL in Canada.
- Send spam, phishing or fraudulent messages, or promote anything illegal.
- Make automated or prerecorded calls without consent, or hide or fake who is calling.
- Harass, threaten or abuse anyone.
- Break carrier rules, including the rules for registered texting campaigns.
- Get around AgencyPhone's security or limits, or access accounts that are not yours.
We may suspend numbers or accounts that break these rules. Carriers may also block or filter calls and texts on their own.
5.Consent, texting registration and opt-outs
- Agencies are responsible for making sure their clients have the consent the law requires to call and text their contacts.
- Texting from US numbers requires a texting registration for each subaccount. Texts may be blocked or limited until the registration is approved. Registration fees are charged when they are incurred.
- When someone replies STOP, AgencyPhone stops texts from that number to them. Do not try to get around an opt-out.
6.Phone numbers
- Numbers are assigned to your account while it stays in good standing. You do not own them.
- You can bring numbers to AgencyPhone, and move them out where carriers allow it.
- Closing a subaccount starts a 30-day closing period. After it, the account's numbers are released and its information is deleted. A released number cannot be recovered.
7.Emergency calling (9-1-1)
This app doesn't call 9-1-1. For an emergency, dial 9-1-1 from your phone's own keypad. It connects directly and shares your phone's location. Business calls in this app need internet and power.
- AgencyPhone numbers carry no 9-1-1 service and the app doesn't place 9-1-1 calls. Anyone who dials 9-1-1 or another short code in the app is told to use their phone's own keypad instead.
- Business calls in the app may not work during an internet or power outage.
- Make sure everyone who uses AgencyPhone knows this, and keep another way to reach emergency services.
8.Call recording
Call recording is off unless a subaccount turns it on. If it is on, the agency and the client are responsible for any notice and consent the law requires. Some states and provinces require the consent of everyone on the call. AgencyPhone can play an announcement at the start of recorded calls.
9.Your content and data
- Calls, texts, voicemails, recordings and contacts belong to you or your clients. You allow us to store, process and send them only to provide and protect AgencyPhone.
- An agency's team can read and reply to its clients' calls and texts, limited to the clients the agency gives each person access to.
- Our privacy policy explains how we handle personal information.
10.API and connected software
- Keep API keys and webhook secrets private. You are responsible for requests made with your keys.
- Follow the rate limits and the API documentation.
- Software you connect receives your clients' call, text and voicemail information. You are responsible for how it uses that information.
11.Other services we rely on
AgencyPhone depends on carriers and service providers, such as Telnyx for calls and texts and Stripe for payments. Their availability is outside our control.
12.Suspension and closing
- You can close subaccounts or your agency at any time from the dashboard.
- We may suspend or close an account that breaks these terms, does not pay, or puts people or AgencyPhone at risk, or when the law or a carrier requires it. Where it is reasonable, we will tell you first and give you a chance to fix the problem.
13.Availability and changes
We work to keep AgencyPhone running reliably, but calls and texts depend on carriers, networks and devices, so we cannot promise that every call connects or every text is delivered. We may change or improve features over time.
14.Disclaimer
AgencyPhone is provided as is and as available. To the extent the law allows, we make no promises beyond the ones in these terms, including any implied promise that AgencyPhone is fit for a particular purpose.
15.Limitation of liability
To the extent the law allows, Creative Code is not liable for indirect or consequential losses, such as lost profits, lost business or lost data, or for being unable to reach emergency services through AgencyPhone. Our total liability for any claim about AgencyPhone is limited to the amount you paid us in the 12 months before the claim.
16.Responsibility for your use
You agree to cover the claims, losses and costs, including reasonable legal fees, that come from how you, your team, your clients or your connected software use AgencyPhone, including calls and texts made without the consent the law requires.
17.Changes to these terms
We may update these terms. If a change is significant, we will tell account owners by email before it takes effect. Using AgencyPhone after that means you accept the updated terms.
